Agile Style

Contractor uses an agile approach to project management – working in shorter phases, continually managing shifting priorities, and releasing progress whenever possible.

Onboarding

Contractor begins all projects with a site evaluation scope to examine Client’s website requirements and existing website, as applicable. Contractor formulates tasks to bring the website up to supportable standards, recommends solutions, holds a project kickoff call, and formulates the next steps.

Payments

Development work is metered hourly at the current rate in fifteen minute increments. An order with a positive balance of hours is required. Net-30 payment term is available for Client when in good standing. Past due will suspend all work until settled.

Service Plans

Service plans are still hourly work, but done in bulk. These are billed on the first of each month as fifteen minutes for each of monitoring, routine maintenance, and private server updating (where applicable). They are billed against the latest order balance. Maintenance covers routine only, will at times demand development work sold separately.

Refunds

Unused hours within two years of order date may be refunded upon request. Service plan deductions are month-to-month and are non-refundable.

Estimates

Development estimates are rough and can be inaccurate as Contractor does custom work with various phases, changes, and external components.

Materials

Client will sign up and pay for their website or hosting service and all desired third-party components that they hold license to.

Meetings

Meetings are billable project management time. Appointments are open 9am-5pm Pacific time as available with reasonable notice.

Scheduling

Contractor schedules development work once sufficient hours are ordered on account. Contractor’s schedule supports concurrency while remaining available to support Clients’ needs on demand up to around ten hours per week.

Urgency

Contractor does not accept any rush work, deadlines, or pressures to deviate from usual process.

Status

If Client does not respond to inquiries within 30 days their project becomes suspended. Resumption may require lead time and other changes.

Other Developers

Contractor functions as Head Developer on most projects, policing activities to ensure stability, establishing boundaries for less qualified resources. Each resource must use their own credentials and expect to be managed accordingly. Violators will have their access suspended.

Confidentiality

Contractor and Client will treat all data and communications not generally known in the industry as confidential and will protect accordingly.

Intellectual property

Contractor adheres to the licensing of the platform being serviced. WordPress uses open-source GPLv2+ licensing. Any further works are licensed to Client without exclusivity except as defined by a Copyright Assignment Agreement.

Term

Agreement is in effect until the completion of the services or a cancellation is requested in writing by mail or email.

Limited liability

Contractor cannot be held responsible for any form of damages. Any claim, cause or action arising in connection with this agreement shall not exceed $2,500.

Resolution

Contractor and Client agree to indemnify each other, hold each other harmless, and agree to binding arbitration by a mutually accepted arbitrator meeting virtually.
